Who can apply the application for permanent residence in Japan.

About the conditions.

 

1. Working visa holder:

 
In principle, the person has stayed in Japan for more than 10 years consecutively. It is also required that during his/her stay in Japan the person has had work permit or the status of residence for more than 5 years consecutively in Japan.

It means, the important point is that whether the applicant has paid the residence tax and social insurance or not. In the 5 years.
For example, in case of the corporation that you are working in Japan became bankrupt in the period of examination for permanent, there is a case that the inspector give you other special chance.
For example, in case of you have to be transfer to other country even you are living in Japan 9 years, and wish to gain the permanent, it will makes you ultimate decision that's why if you choice the transferred then you can't be applied the permanent residence.

 

2. Spouse visa holder (and Long Term holder has married with Japanese or Permanent):

 
An applicant who has been living with the spouse more than three years stable life in Japan.

About the 3 years :
if you have the time such like a living apart separately once , the 3 years count is newly started from when you are started living with your spouse.

The person is a spouse of a Japanese national, special permanent resident or permanent resident, and has been in a real marital relationship for more than 3 years consecutively and has stayed in Japan more than 1 year consecutively.
 

3. Child of permanent resident and second generation Japanese:

 
An applicant who has been staying more than 1 year in Japan.
 
the person is a true child of a Japanese national, special permanent resident or permanent resident, and has stayed in Japan more than 1 year consecutively.
 

4. Regarding the point score of the Highly skilled foreign professional.

 
A. The person has a total score of 70 points or more based on the points calculation criteria prescribed in the Ordinance to Provide for the Criteria in the Right-Hand Column Corresponding to “Highly-Skilled Professionals as Specified in Appended Table I(2) of the Immigration Control and Refugee Recognition Act” (hereinafter referred to as “Ordinance of the Ministry of Justice”), and comes under one of the following.
 
①. The person who has continuously stayed in Japan as a “Highly-Skilled foreign Professional” for 3 years or more.
 
②. The person who has continuously stayed in Japan for 3 years or more, and who is deemed to have a total of 70 points or more when calculating with reference to the situation at 3 years before the date of the application for permission for permanent residence.
 
B. The person has a total score of 80 points or more based on the points calculation criteria prescribed in the “Ordinance of the Ministry of Justice” , and comes under one of the following.
 
①. The person who has continuously stayed in Japan as a “Highly-Skilled foreign Professional” for 1 year or more.
 
②. The person who has continuously stayed in Japan for 1 year or more, and who is deemed to have a total of 80 points or more when calculating with reference to the situation at 1 year before the date of the application for permission for permanent residence.
 
C. ( For J-Skip Visa Holder (Special Highly Skilled Foreign Professionals Holder) The person who meets the criteria stipulated in the Ministerial Ordinance that stipulates the standards for Special Highly Skilled Professionals (hereinafter referred to as "Ministerial Ordinance for Special Highly Skilled Professionals") and falls under any of the following:
A. Have been residing in Japan continuously for more than one year as a "Special Highly Skilled Foreign Professionals".
B. He/She has been residing in Japan continuously for one year or more, and is recognized as meeting the criteria stipulated in the Ministerial Ordinance for Special Highly Skilled Foreign Professionals as of one year prior to the date of application for permission for permanent residence.
 

〇Advanced academic research activities「Highly-Skilled Professional(i)(a)」
Activities of engaging in research, research guidance or education based on a contract entered into with a public or private organization in Japan.
〇Advanced specialized/technical activities「Highly-Skilled Professional(i)(b)」
Activities of engaging in work requiring specialized knowledge or skills in the field of natural sciences or humanities based on a contract entered into with a public or private organization in Japan.
〇Advanced business management activities「Highly-Skilled Professional(i)(c)」
Activities of engaging in the operation or management of a public or private organization in Japan.

5. Long Term visa holder:( in case of no marriage)

 
An applicant who has been staying more than 5 year in Japan.
 

6. The person who has recognaized refugee.

 
The person has been recognized as a refugee, and has stayed in Japan for more than 5 years consecutively after recognition.
 

7.The person who has contribution to Japan.

 
The person has been recognized to have made a contribution to Japan in diplomatic,social, economic, cultural or other fields, and has stayed in Japan for more than 5 years.

The person has continuously stayed in Japan for 3 years or more in cases where such person engaged in the activities coming under any of item (xxxvi) or item (xxxvii) of the public notice (Public Notice No. 131 of 1990) specifying the activities listed in the right-
hand column of Appended Table I(5) of the Immigration Control and Refugee Recognition Act pursuant to the provisions of Article 7, paragraph (1), item (ii) of the same Act at a public or private organization located within the area of the plan specified in the regional revitalization plan approved under Article 5, paragraph (16) of the Regional Revitalization Act (Act No. 24 of 2005), and these activities are deemed to have made a contribution to
Japan.
